What ProofEcho Provides
ProofEcho is a platform for collecting, managing, and showcasing customer testimonials in text, video, and audio formats. We provide tools including collection forms, a testimonial dashboard, embeddable widgets, analytics, and automation features.
Your Account
- Minimum age.You must be at least 16 years old to create a ProofEcho account. ProofEcho is a business tool and is not directed at children. If we learn that an account was created by someone under 16, we will close the account and delete the associated data. If you collect testimonials from children under 16 through your ProofEcho forms, you are responsible for obtaining verifiable parental consent in line with COPPA, the UK Children's Code, and any equivalent law in your jurisdiction.
- You must provide accurate information when creating an account.
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity under your account.
- One person or entity may create multiple organizations, each with its own billing and team members.
Free and Pro Plans
- ProofEcho offers a free plan with up to 30 testimonials, 1 organization, 1 collection form, 1 Wall of Love page, and all six widgets (with a small Powered by ProofEcho badge). No credit card required.
- Pro is $24 per month or $240 per year. Pro unlocks unlimited testimonials, audio and video up to 5 minutes each, up to 10 collection forms, up to 5 Wall of Love pages, the Brand Kit (custom fonts and colors), removal of the Powered by ProofEcho badge, AI testimonial analysis, automated thank-you emails, and Slack and Discord notifications. Additional organizations are billed at $10 per seat per month.
- Pro subscriptions are billed monthly or yearly through Polar. You can cancel at any time.
- If you cancel or downgrade from Pro, your account reverts to free-tier limits at your current billing period end. Every testimonial's text, rating, author, and tags are kept indefinitely. For 90 days after the downgrade you can resubscribe and nothing is touched. If you do not resubscribe within those 90 days, we run a one-time media cleanup that removes image files on testimonials beyond your latest 100, plus video files beyond your latest 10 video testimonials and audio files beyond your latest 20 audio testimonials. Text, ratings, and trust badge scores are unaffected. You can download all your data at any time during the countdown.
Payments and Refunds
- All Pro plan purchases are final and non-refundable, except where required by applicable law. Before completing a purchase, you are asked to confirm that you understand this policy.
- If a payment fails, your subscription may be paused or canceled depending on the billing provider's retry policy. We will notify you of any billing issues so you can update your payment method.
- When upgrading from monthly to yearly billing, you are charged immediately for the yearly plan. Any remaining time on the monthly plan is not refunded or credited.
- We reserve the right to change pricing with at least 30 days' notice. Price changes do not affect your current billing period.
Intellectual Property
- ProofEcho owns the software, service, branding, design, and all related intellectual property. Your use of the service does not grant you any ownership of our platform or technology.
- You own the content you create and upload to ProofEcho (forms, settings, brand assets).
- Testimonials submitted through your forms are provided by your customers. You are responsible for obtaining appropriate consent from testimonial submitters before publishing their content.
- ProofEcho does not claim ownership of your content. We store and display it solely to provide the service.
- We may display testimonials publicly through widgets, embeds, and pages as configured by you.
Testimonial Submitter Consent and Data Processing
For the personal data of your customers (testimonial submitters), you are the data controller and ProofEcho acts as a data processor on your behalf.
Built-in consent capture. Every public ProofEcho form requires the submitter to pick a sharing preference before they can finish the submission — this step cannot be skipped. The available options are:
- Public — the submitter consents to public display on widgets, Wall of Love pages, and other ProofEcho-rendered surfaces
- Granular — the submitter consents to specific channels only (for example, your website but not third-party platforms)
- Private — the submitter does not consent to any public display. The testimonial is kept in your dashboard for internal use only
Automatic filtering on public surfaces. Our widget, embed, and Wall of Love render paths automatically filter out testimonials whose submitter did not consent to public display. This filtering happens server-side and applies to every public surface ProofEcho serves. Aggregate metrics (rating badges, Analyze counts, downloadable reports) include all approved testimonials because the data is anonymized and aggregated.
As a ProofEcho customer, you agree to:
- Respect the consent preferences chosen by submitters within and outside of ProofEcho
- Not export, screenshot, transcribe, or republish testimonials marked as private outside ProofEcho without first obtaining separate explicit permission from the submitter
- Handle submitter data (name, email, media) in compliance with applicable privacy laws in your jurisdiction (including GDPR, CCPA / CPRA, and equivalents)
- Maintain your own privacy notice and lawful basis for collecting testimonials from your customers — the ProofEcho Privacy Policy covers our handling of the data, not yours
- Business customers subject to GDPR may request our Data Processing Agreement (DPA) by emailing [email protected]
ProofEcho is responsible for technical enforcement of the consent recorded inside the platform. ProofEcho is not responsible for any use of testimonial data that you, your team, or any third party performs outside the ProofEcho platform, including but not limited to: republishing private testimonials on external websites, sharing exports with parties not covered by your own privacy notice, or using testimonial content in ways not covered by the consent the submitter selected.
Your Responsibility for Submitter Claims
Because you are the data controller for the testimonials your customers submit through ProofEcho, you are responsible for the lawful collection and use of that data. If a testimonial submitter (or any third party acting on their behalf) brings a claim, complaint, or legal action against ProofEcho that arises out of (a) your use of a testimonial outside the ProofEcho platform, (b) your failure to honour the consent preference the submitter selected on the form, (c) inaccurate or misleading content you published, or (d) your breach of these terms or applicable privacy law, you agree to defend ProofEcho against the claim and to cover the reasonable legal costs, settlements, and damages we incur as a result.
ProofEcho will tell you promptly if we receive such a claim, give you reasonable cooperation in the defence, and not settle the claim in a way that admits fault on your behalf without your consent. This section does not apply to claims caused by ProofEcho's own breach of these terms, our gross negligence, or our wilful misconduct.
Acceptable Use
You agree not to:
- Use ProofEcho for illegal purposes
- Upload malicious content, malware, or content that violates others' rights
- Attempt to access other users' accounts or data
- Abuse the platform through automated scraping, excessive API calls, or deliberate overloading
- Create fake or misleading testimonials to deceive consumers. This includes uploading or publishing testimonials whose text, voice, or video was generated wholly or in part by AI, synthetic-voice tools, face-swap or other deepfake technology, or any tool that misrepresents a real person's words or likeness, and then presenting that content as a real customer's testimonial. The sample seed testimonials we generate inside your dashboard for onboarding are clearly labelled and are not subject to this rule unless you publish them to the public as if they were real customer voices
- Use the service to send unsolicited bulk emails (spam) through testimonial request features
- Engage in fraud, impersonation, or any activity that compromises the security or integrity of the platform
Suspension, Inactivity, and Termination
- You can delete your account at any time from your account settings. A verification email is sent before deletion is finalised; once confirmed, deletion is immediate.
- We may suspend or terminate accounts that violate these terms, engage in abuse, fraud, spam, or behaviour that harms the platform or other users. We will provide notice when possible, but reserve the right to act immediately if the situation requires it.
- If your account is suspended for a policy violation, you may contact us to appeal. We will review and respond within a reasonable timeframe.
- Inactive organizations. If your organization becomes inactive (no Pro subscription and no activity), we follow our organization-lifecycle policy: after a grace period it is archived (read-only widgets and forms), and after a further period it is soft-deleted. We email you at each stage so you can re-activate or export your data before deletion.
- Upon account or organization deletion, your data is removed as described in our Privacy Policy.
Integrations
ProofEcho offers optional integrations with third-party services (Slack, Discord, and others). When you connect an integration, you authorize ProofEcho to send data (such as testimonial notifications) to that service. You can disconnect integrations at any time. We are not responsible for how third-party services handle your data after it leaves ProofEcho.
Public Embeds and APIs
ProofEcho serves widgets, Wall of Love pages, and embeds that you publish on your own websites, as well as read-only public APIs (such as the testimonial and widget endpoints used by our embed loader). You are responsible for embedding our widgets only on properties you control and for ensuring that any testimonials displayed comply with the consent choices selected by their submitters. We may apply reasonable rate limits, cache responses, and require attribution (a Powered by ProofEcho badge on the free plan).
We are not liable for damages arising out of your use of the public APIs or the embed loader, including outages, response-time variability, breaking changes communicated with reasonable notice, or third-party content displayed through your widgets. Scraping, reverse-engineering, or using the APIs to build a competing testimonial-collection service is not permitted.
Availability and Changes
- We aim to keep ProofEcho available and reliable, but we do not guarantee 100% uptime.
- Planned maintenance. We may occasionally take ProofEcho offline for upgrades, migrations, or security patches. When possible, we schedule maintenance during low-traffic hours and post advance notice in the application or by email. Downtime caused by planned maintenance, by upstream providers (Railway, Cloudflare, Polar, Resend, OpenAI), or by events outside our reasonable control is not a breach of these terms.
- Support response. We aim to respond to billing, account, and privacy questions within two business days. Bug reports and feature requests are best-effort.
- We may update, modify, or discontinue features with reasonable notice.
- We may update these terms. If we make significant changes, we will notify you through the application or by email. Continued use after changes constitutes acceptance.
Limitation of Liability
ProofEcho is provided “as is” without warranties of any kind. To the fullest extent permitted by law, ProofEcho is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months before the claim.
Force Majeure
ProofEcho is not liable for any failure or delay in performing its obligations caused by events beyond our reasonable control, including but not limited to outages or failures of upstream hosting providers, network or internet failures, cyberattacks, natural disasters, war, terrorism, government action, or pandemics. We will use commercially reasonable efforts to resume service as soon as practicable.
Assignment and Change of Control
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign these terms to a successor in the event of a merger, acquisition, sale of assets, or reorganization. If a change of control occurs, we will notify active customers by email and the successor will be bound by the same commitments described in these terms and our Privacy Policy.
Severability and Entire Agreement
If any provision of these terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. Our failure to enforce any right under these terms is not a waiver of that right. These terms, together with our Privacy Policy and any Data Processing Agreement signed between you and ProofEcho, constitute the entire agreement between you and ProofEcho regarding the service and supersede any prior agreements on the same subject matter.
Governing Law
These terms are governed by the laws of the Republic of Indonesia. Any disputes will be resolved in the courts of Indonesia, unless otherwise required by local consumer protection laws in your jurisdiction.
